Announcement of the Customs Tariff Commission of the State Council on implementing the Market-oriented Procurement Exclusion Regarding the US Products Subject to Additional Tariffs

In accordance with laws and regulations including the Customs Law of the People's Republic of China, the Foreign Trade Law of the People's Republic of China, and the Regulations of the People's Republic of China on Import and Export Duties, and upon approval of the State Council, the Customs Tariff Commission of the State Council has announced to implement the Market-oriented Procurement Exclusion regarding the US Products Subject to Additional Tariffs. 

From March 2, 2020, the Customs Tariff Commission will begin to accept applications from relevant enterprises in China, and will evaluate each application on a case-by-case basis. Any qualified procurement based on market-oriented and commercial-oriented principles, will not be subject to the additional tariffs imposed as countermeasures against the US Section 301 measures for a certain period, so as to support enterprises to procure and import US products based on commercial considerations. 

Enterprises in China that intend to enter into contracts to procure and import goods from the US are eligible to submit applications through the Exclusion Application System (website of the Customs Tariff Policy Research Center of the Ministry of Finance: https://gszx.mof.gov.cn), based on the product list available for exclusion application, as well as their own needs.  

Based on the submition and the exclusion applications regarding the first and second batch of US products subject to additional tariffs, the Customs Tariff Commission of the State Council will evaluate each application on a case-by-case basis and will timely notify the applicants through the Exclusion Application System.
