Announcement of the Customs Tariff Commission of the State Council on the Second Exclusion List Regarding the Second Batch of US products Subject to Additional Tariffs

In accordance with the Announcement of the Customs Tariff Commission of the State Council on the Trial Implementation of the Exclusion of US Products Subject to Additional Tariffs (Announcement No. 2 [2019], Customs Tariff Commission of the State Council), and upon approval of the State Council, the Customs Tariff Commission of the State Council has announced the second exclusion list of US products regarding the second batch of US products subject to additional tariffs.

From May 19, 2020 to May 18, 2021, products on the list will not be subject to the additional tariffs imposed as countermeasures against the US Section 301 measures . Additional tariffs that have already been paid shall be refunded, and relevant importers shall apply for tariff refund according to relevant requirements, within six months from the date of the announcement. The rest of the second batch of U.S. products subject to additional tariffs will not be excluded for the time being.

For those not included in the exclusion lists regarding the first and second batch of US products subject to additional tariffs, enterprises can apply for the exclusion of  market-oriented procurement, in accordance with the Announcement of the Customs Tariff Commission of the State Council on Implementing the Market-Oriented Procurement Exclusion regarding US Products Subject to Additional Tariffs (Announcement No. 2 [2020], Customs Tariff Commission of the State Council).
