Notice of the Ministry of Finance on the Public Disclosure of Government Procurement Intentions

To all central budget entities, the finance departments (bureaus) of all provincesautonomous regions, municipalities directly under the central government and cities with independent planning status), and the Finance Bureau of Xinjiang Production and Construction Corps,

To further improve the transparency of government procurement and optimize the business environment for government procurement, in accordance with the relevant requirements of the Plan for the Deepening the Reform of the Government Procurement System and the Notice of the Ministry of Finance on Promoting Fair Competition in Government Procurement and Optimizing Business Environment (No. 38 [2019], Ministry of Finance), the following provisions shall apply to public disclosure of government procurement intentions:

I. Attaching great importance to the public disclosure of government procurement intentions

The public disclosure of procurement intentions shall follow the principle of “pilot program first and gradual implementation later.” The pilot program will be launched in 2020 among central budget entities and the municipal budget entities of Beijing, Shanghai and Shenzhen. For procurement projects that will be implemented from July 1, 2020, central budget entities and the municipal budget entities of Beijing, Shanghai and Shenzhen shall disclose procurement intentions to the public as required. All regions in the pilot program shall try to promote budget entities at other levels to make public the procurement intentions as soon as possible based on actual local conditions. Other regions may determine the time for public disclosure of procurement intentions based on actual local conditions. As a general principle, for procurement projects that will be implemented from January 1, 2021 by provincial budget entities and those that will be implemented from January 1, 2022 by budget entities below the provincial level, procurement intentions shall be disclosed to the public as required. Regions with good conditions may advance the disclosure of procurement intentions at a proper time.

Promoting the public disclosure of procurement intentions is an important measure to optimize the business environment for government procurement. It would help increase transparency and facilitate the suppliers to understand government procurement information in advance, and would play an important role in ensuring all market players can participate in the procurement on a level playing field, improving procurement performance, and preventing and combating corruption. All regions and departments should fully understand the significance of this work, attach great importance to it and meticulously organize it so as to effectively disclose procurement intentions to the public.

 

 

III.    Entity and channel of disclosing procurement intentions

Procurement intentions will be made public by budget entities. Procurement intentions of central budget entities will be made public on the main website of the Chinese government procurement website (www.ccgp.gov.cn), with those of regional budget entities disclosed on sub-sections of the website or simultaneously by media outlets designated by finance departments at or above the provincial level. The competent budget entity may collect the procurement intentions of the subordinate departments and the budget units for centralized disclosure together. Subject to some conditions, a department may disclose procurement intentions of itself or the relevant sector on their official website at the same time.  


IV.    Content of public disclosure of procurement intentions

Intentions will be made public according to the procurement items. The procurement intentions of all entities, including information of goods, projects, and services in the centralized procurement catalogue or beyond the procurement quotas, shall be disclosed to the public, with the exception of contractual and designated suppliers of small-sum and sporadic goods or services as well as centralized procurement in bulk organized by centralized procurement institutions in a unified manner. The disclosure of procurement intentions should include the project name, an overview of the demands, the budget and the estimated procurement time, with a Sample of Disclosure of Government Procurement Intentions annexed. In particular, the overview of demands shall include the name of the procurement object, its functions and goals, quantity as well as the requirements for quality, service, safety, and time limits. The disclosure should be sufficiently clear and complete so that suppliers can make good preparation in advance. The procurement intentions shall only serve as a reference for suppliers to understand the preliminary procurement plan; the actual procurement demands, budget and time for the project implementation shall be subject to the final announcement and procurement documents issued by the budget entity.

V.    The decision-making and time of disclosure of procurement intentions

Procurement intentions will be made public by budget entities on a regular or irregular basis. Intentions disclosed prior to the departmental budget approval shall in the end abide by the approved budget following the “two-up operations.” Intentions made public after the approval of the departmental budget are based on the approved budget.

Intentions for procurement items newly added during the budget execution shall be made public in a timely manner. The time for disclosing the procurement intentions shall be as early as possible; in principle, no later than 30 days before the commencement of procurement activities. Procurement projects that are urgently needed for reasons unforeseen by the budget entity may be exempt from public disclosure.

VI.    Work requirements

All central budget entities should strengthen the planning of procurement activities and make public their procurement intentions in a timely and comprehensive manner in accordance with the requirements of this Notice. Central competent budget entities should do a good job of coordination, make timely arrangements for implementation, and strengthen the supervision and guidance of subordinate budget units, and ensure that those units disclose their procurement intentions strictly in accordance with the regulations, without omissions or delays.


The provincial finance departments should make specific work plans according to the requirements of this Notice, arrange regional implementation, give priority to providing guidance to budget entities at the city and county levels in disclosing government procurement intentions, offer publicity dedicated to the work at the regional sub-section of the Chinese government procurement website, and ensure that the budget entities at all levels in the region disclose the procurement intentions according to the requirements.

All regions and departments should earnestly summarize the good practices and experiences in advancing the public disclosure of government procurement intentions, improve measures to cope with new situations and problems, and report to the Ministry of Finance in a timely manner. In evaluating the transparency of government procurement, the Ministry of Finance will inspect the public disclosure of government procurement intentions and notify the inspection results.
